{"id":648,"date":"2025-08-13T19:53:17","date_gmt":"2025-08-13T19:53:17","guid":{"rendered":"http:\/\/lco-projects-work.local\/?post_type=project&#038;p=648"},"modified":"2026-03-07T21:58:50","modified_gmt":"2026-03-07T21:58:50","slug":"protection-orders","status":"publish","type":"project","link":"https:\/\/lco-cdo.org\/en\/projects\/protection-orders\/","title":{"rendered":"Protection Orders"},"content":{"rendered":"\n<div class=\"wp-block-group has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\" style=\"margin-bottom:var(--wp--preset--spacing--medium)\">\n<h2 class=\"wp-block-heading\">Project Overview<\/h2>\n\n\n\n<p>The Law Commission of Ontario is examining why protection orders are failing to prevent intimate partner and family violence in Ontario. <\/p>\n\n\n\n<p>At least 434 people \u2014 mostly women and children \u2014 were murdered in acts of intimate partner violence across the province from 2003 to 2021, according to Ontario\u2019s Domestic Violence Death Review Committee. Most cases had a history of violence, and in a quarter of cases the perpetrator had breached a protection order or other court order.<\/p>\n\n\n\n<p>Protection orders are legal tools meant to prevent violence by imposing conditions on a person causing harm \u2014 such as restricting where they can go or who they can contact. There are many different types of protection orders in Ontario, including restraining orders, peace bonds, bail release orders or undertakings, exclusive possession orders, and criminal sentences with protective conditions. Some First Nations also have their own protection orders.&nbsp;We define these orders and related terms in our <a href=\"https:\/\/lco-cdo.org\/protection-order-glossary\/\" data-type=\"page\" data-id=\"466\">Project Glossary<\/a>.<\/p>\n\n\n\n<p>When they work, protection orders can save lives. We\u2019re examining how protection orders work in practice \u2014 including issues of access, process, evidence, conditions, duration, and enforcement. We\u2019re also considering whether Ontario should introduce standalone civil protection order legislation, and how to improve coordination across systems.<\/p>\n\n\n\n<p>On December 11, 2025, the LCO released our provincial <a href=\"https:\/\/lco-cdo.org\/en\/publications\/improving-protection-orders-in-family-child-protection-and-civil-law-consultation-paper\/\">Consultation Paper on Improving Protection Orders in Family, Child Protection, and Civil Law<\/a>. There is also an <a href=\"https:\/\/lco-cdo.org\/en\/publications\/improving-protection-orders-in-family-child-protection-and-civil-law-consultation-paper-executive-summary\/\">Executive Summary<\/a>.<\/p>\n\n\n\n<p>The Consultation Paper sets&nbsp;out key issues, options for reform, and questions for feedback from survivors, legal professionals, community advocates, service providers, academics, and the broader public. The Consultation Paper is based on what we\u2019ve learned so far, including our preliminary research, informal meetings, case law review, and two LCO surveys.<\/p>\n\n\n\n<p>Issues considered in the Consultation Paper include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The need for emergency orders<\/li>\n\n\n\n<li>Expanding eligibility to apply<\/li>\n\n\n\n<li>Trauma-informed processes<\/li>\n\n\n\n<li>Effectiveness of the \u201creasonable fear\u201d standard<\/li>\n\n\n\n<li>Whether conditions and durations meet safety needs<\/li>\n\n\n\n<li>A centralized database of protection orders<\/li>\n\n\n\n<li>Monitoring compliance<\/li>\n\n\n\n<li>Appropriate consequences for breaches<\/li>\n\n\n\n<li>Conflicting court orders<\/li>\n\n\n\n<li style=\"margin-bottom:var(--wp--preset--spacing--medium)\">Supplementary strategies for protection<\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-kadence-spacer aligncenter kt-block-spacer-648_e75da6-42\"><div class=\"kt-block-spacer kt-block-spacer-halign-center\"><hr class=\"kt-divider\"\/><\/div><\/div>\n\n\n\n<h2 class=\"wp-block-heading\" style=\"margin-top:var(--wp--preset--spacing--medium)\">Current Project Phase<\/h2>\n\n\n\n<p>The LCO released its Consultation Paper on Improving Protection Orders in Family, Child Protection, and Civil Law in December 2025. Consultations run until March 13, 2026.<\/p>\n\n\n\n<p>In 2025, the LCO conducted a Community Survey and a Professional Stakeholder Survey to hear from Ontarians about their personal and professional experiences with protection orders and their ideas for change.
